States race to protect your brain waves as neurotech goes mainstream

The technology has taken a leap from the doctor’s office to the consumer wearables market.

A movement to grant consumers privacy protections for their neural data has produced five state laws in the past two years, with a potential sixth awaiting governor approval.

Colorado enacted the nation’s first law in 2024, followed months later by California. Connecticut and Montana joined the trend in 2025, and Vermont did so this year. Delaware lawmakers passed a neural rights bill, but it has not yet been signed.
