Health-related ‘geofencing’ banned in Wash. as new law takes effect

Other states adopted similar but narrower protections after Washington State lawmakers passed it earlier this year.

Strict limits on targeting consumers by using “geofencing” are now in place in Washington State after key provisions of a sweeping health data privacy law took effect Sunday.

Under the Washington My Health My Data Act, it is now illegal to create a virtual boundary — known as a “geofence” — within 2,000 feet of a location that provides in-person health care services, if the geofence is used to target consumers based on their health-related needs.
